Medical FSA Plan Document Update
 Amendment Required

 

Description: News FlashNow that the U.S. Supreme Court has upheld the Patient Protection and Affordable Care Act (PPACA), Section 9005 amends Section 125 of the Internal Revenue Code to cap Medical Flexible Spending Account (FSA) salary reductions for plan years beginning on or after January 1, 2013 at $2,500.

This regulation change requires modification to your Plan Document.
 

If you are a current plan document client, Crosby will automatically send an amendment. Amendments to your plan document will need to be appropriately adopted which may require assistance of Legal Counsel before January 1, 2013.

IRS Considers Changes to Use-It-Or-Lose-It  


Elsewhere, there has been increased traction surrounding the concept to eliminate the FSA use-it-or-lose-it rule, especially now that the new $2,500 Medical FSA maximum is taking effect on January 1, 2013. A common-sense approach would allow participants to roll over their unused funds into the next plan year rather than forcing them to spend down their elections. Go Green! Go Paperless!
 
Boosting E-Communication and Direct Deposit Participation

 

Description: GoGreen_SmaillLast month, Crosby refreshed its Go Green! Campaign in an effort to significantly increase direct deposit and paperless communication participation among reimbursement account holders. The following two initiatives were launched:
 

1. Our Go Green! Go Paperless! insert was sent with every July Summary Statement explaining how participants can easily sign up for direct deposit and electronic communications.

2. We sent a similar email to all participants (with an email address) that have not yet signed up for direct deposit and/or electronic communications.

With your help and our continued efforts, we hope to reach our goal of 70% participation by the end of this year. To date, 30% of our account holders have signed up.

 

What you can do to help: Crosby can provide an article/language that you can put in your newsletter or on your employee website. Please help us publicize this effort.

While this is a bold goal, we are committed to reaching it so that we can keep costs down (as postage and mailing costs increase) and reduce the amount of paper used to communicate with participants, thus generating less waste. We look forward to future initiatives and greater participation as we head toward the renewal season.

Don't forget: a new $2,500 limit will be imposed on Medical FSA annual elections beginning January 1, 2013. Thus, making sure your employees are aware of the changes is important. Since we receive many requests to participate, please understand that scheduling is done on a first-come-first-serve basis. Transit Benefit Parity Still Possible

MAP-21 and HR 6606-Commuter Savings Act 

 

Description: CommuterIn late June, the U.S. Senate and House of Representatives adopted the conference agreement to the "Moving Ahead for Progress in the 21st Century Act (MAP-21)" to reauthorize surface transportation programs. Though the Senate-adopted version of the legislation called for a one-year extension of parity between the transit and parking benefit, the transit provision was not included in the joint legislation. However, Congress is expected to consider a tax extenders package later this year that may include the transit provision.

In addition, Representative Nan Hayworth (R-NY, 19th) introduced H.R. 6606, the Commuter Savings Act, that would extend the parity between transit and parking benefits through the end of 2013. To date, Reps. Robert Dold (R-IL, 10th) and Peter King (R-NY, 3rd) have joined as cosponsors.
